Terms of Service

DizzyCal is a product of Wallabout Collective Inc.. Effective May 19, 2026. Last updated May 19, 2026.

These Terms of Service ("Terms") govern your access to and use of DizzyCal, operated by Wallabout Collective Inc.. By creating an account, using the Service, or subscribing to a calendar, you agree to these Terms.

1. Agreement to terms

DizzyCal is a product of Wallabout Collective Inc. ("Wallabout," "we," "us," or "our"). These Terms form a binding agreement between you and Wallabout. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree to these Terms or our Privacy Policy, do not use the Service.

2. The Service

DizzyCal lets creators build branded calendar subscription pages, publish schedules, and deliver events to subscribers through calendar feeds and related tools. Features may include hosted URLs, custom domains, design customization, subscriber management, exports, webhooks, APIs, and paid plan upgrades.

We may modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to provide notice of material changes that affect paid customers.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a creator account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate registration information and keep it current. Notify us promptly at hello@dizzycal.com if you suspect unauthorized access to your account.

4. Plans, billing, and taxes

DizzyCal offers free and paid subscription plans with different feature limits, including caps on calendars, subscribers, and API usage. Current plan details are described on our pricing page.

Paid subscriptions are billed in advance through Stripe on a recurring basis unless canceled. Prices are shown in U.S. dollars unless otherwise stated. You authorize us and our payment processor to charge your selected payment method for applicable fees, taxes, and renewals.

Except where required by law, fees are non-refundable. You may cancel at any time; cancellation stops future billing but does not retroactively refund the current billing period unless we agree otherwise in writing.

We may change plan prices or limits with advance notice. Continued use after a price change takes effect constitutes acceptance of the new pricing for renewal periods.

5. Creator responsibilities

If you publish calendars or collect subscribers, you agree that you will:

  • Have the rights needed to publish your events, branding, and other content
  • Provide a lawful basis for collecting subscriber information and honoring consent choices
  • Comply with applicable marketing, privacy, and consumer protection laws
  • Not misrepresent your identity, affiliation, or the nature of the events offered
  • Maintain accurate schedules and honor reasonable subscriber expectations
  • Respond to subscriber requests where you are the data controller for that relationship

You are solely responsible for the content you publish and for your relationship with subscribers, even though Wallabout provides the underlying platform.

6. Subscriber terms

When you subscribe to a creator's calendar, you receive access to calendar feeds and related functionality offered by that creator through DizzyCal. Your use may be subject to the creator's policies in addition to these Terms and our Privacy Policy.

Subscribers must provide accurate information, use feeds only for personal or authorized purposes, and not attempt to scrape, resell, or abuse subscription tokens or API endpoints.

7. Acceptable use

You may not use the Service to:

  • Violate any law, regulation, or third-party rights
  • Upload malware, spam, deceptive content, or harmful code
  • Harass, threaten, defame, or discriminate against others
  • Infringe intellectual property, publicity, or privacy rights
  • Attempt to gain unauthorized access to accounts, systems, or data
  • Interfere with or disrupt the Service, including excessive automated requests
  • Circumvent plan limits, authentication, or security controls
  • Use the Service for unlawful surveillance, phishing, or fraud

We may investigate violations and remove content, suspend accounts, or terminate access without refund if we reasonably believe you have breached these Terms or pose a risk to the Service or other users.

8. Your content and license

You retain ownership of content you submit to the Service ("Your Content"). You grant Wallabout a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, display, and distribute Your Content solely to operate, provide, improve, and promote the Service as you direct through product features.

You represent that you have all rights necessary to grant this license and that Your Content does not violate these Terms or applicable law. You may export or delete Your Content through available product features, subject to reasonable backup and legal retention limits.

9. Wallabout intellectual property

The Service, including software, design, trademarks, documentation, and underlying technology, is owned by Wallabout or its licensors and protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

You may not copy, modify, reverse engineer, or create derivative works of the Service except where such restrictions are prohibited by law or expressly permitted by our API documentation.

10. API access

If you use our API, you must comply with applicable documentation, rate limits, and authentication requirements. API keys must be kept confidential. You are responsible for all usage under your keys. We may revoke API access for abuse, security concerns, or nonpayment.

11. Custom domains and third-party services

Custom domains, calendar apps, payment processors, and other third-party services may be subject to separate terms. We do not control third-party services and are not responsible for their availability, security, or conduct. You are responsible for configuring DNS records, domain ownership, and third-party accounts correctly.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLABOUT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or that calendar feeds will sync perfectly in every calendar client. Creators are responsible for the accuracy and timeliness of their published events.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLABOUT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO WALLABOUT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limits may not apply to you.

14. Indemnification

You will defend, indemnify, and hold harmless Wallabout and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, your relationship with subscribers, or your violation of these Terms or applicable law.

15. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, create legal or security risk, or if we discontinue the Service.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, and indemnification.

16. Dispute resolution and governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

Except where prohibited by law, you and Wallabout agree that disputes arising out of these Terms or the Service will be resolved through binding arbitration on an individual basis, and not in a class, consolidated, or representative action. Either party may seek injunctive relief in court for misuse of intellectual property or unauthorized access.

17. General

These Terms, together with the Privacy Policy and any order or plan-specific terms, constitute the entire agreement between you and Wallabout regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
